Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these terms. If you do not agree to all the terms and conditions, then you are expressly prohibited from using the site and must discontinue use immediately.

Overview

This website is operated by RH Dedicated Sales and Marketing, trading as Go to Garden. Throughout the site, the terms "we", "us" and "our" refer to Go to Garden. Go To Garden is powered by Shopify, which provides the e-commerce platform that allows us to sell our curated products and services to you.

Section 1 - Eligibility & User Representations

By using this Site, you represent and warrant that:

  • You are at least 18 years of age. Persons under the age of 18 are not permitted to use or register for the Site.
  • All registration and purchase information you submit will be true, accurate, current, and complete.
  • You will maintain the accuracy of such information and promptly update it as necessary.
  • You have the legal capacity and you agree to comply with these Terms of Service.
  • You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.
  • Your use of the Site will not violate any applicable law or regulation.

Section 2 - The Contract & Order Acceptance

  • When you place an order, you will receive an order confirmation email. This confirms we have received your order but does not constitute a binding contract between us.
  • A binding contract is formed only when we send you a formal dispatch notification or invoice.
  • We reserve the right to decline, refuse, or cancel any order placed through the Site for reasons including supplier stock unavailability, regional delivery constraints, or pricing errors.
  • We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address.
  • We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by unauthorised dealers, resellers, or distributors.
  • We explicitly reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. In any case where an order is declined or cancelled post-payment, you will be notified promptly and any payment taken will be refunded in full within 14 calendar days.

Section 3 - Products, Brand Restrictions & Material Variances

  • Every product in our range is an "Expert's Choice," personally vetted for quality and value.
  • Live Stock & Perishable Items: Items such as seed potatoes, bulbs, onion/garlic sets, and live plants are highly perishable. Their actual appearance, size, and colour may vary from the illustrative images shown on your device, which is completely normal for living agricultural material.
  • Natural Wood & Timber Products: For all natural timber products, including our branded bushelcrate range, wood is an organic material subject to natural variations. Differences in grain patterns, natural knots, minor colour shifts, and slight surface splitting or warping caused by atmospheric changes or outdoor weathering are expected characteristics of natural wood and do not constitute product defects.
  • Product Availability: All products are subject to availability, and we cannot guarantee that items will always be in stock. We reserve the right to discontinue any product at any time for any reason without notice.
  • British Potato Trade Association (BPTA) Compliance: When purchasing any potato products through our website, the buyer explicitly agrees to be bound by the British Potato Trade Association (BPTA) Conditions of Purchase & Sale, which govern agricultural limitations and liabilities.   • Brand & Marketplace Resale Restrictions: Products offered on this website are intended strictly for end-consumer use. The buyer is not permitted to sell "Jamieson Brothers" branded products, use "Jamieson Brothers" or "JBA Seed Potatoes" images, or list any third-party manufactured products purchased from us on online marketplaces such as Amazon, eBay, or unauthorised commercial websites without prior written consent from the trademark owner. The "bushelcrate" brand, logos, and designs remain the exclusive intellectual property of Go to Garden and RH Dedicated Sales and Marketing.

Section 4 - Prohibited Activities & Anti-Scraping Guards

As a user of the Site, you agree not to:

  • Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any content.
  • Disparage, tarnish, or otherwise harm, in our opinion, us, our brands, or the Site.
  • Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
  • Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.
  • Use a buying agent or purchasing agent to make purchases on the Site.
  • Use the Site as part of any effort to compete with us or use the content for any unauthorised revenue-generating endeavour or commercial enterprise.

Section 5 - Guidelines for User Reviews & Submissions

  • Review Criteria: We may provide areas on the Site for you to leave reviews or ratings. When posting a review, you must have firsthand experience with the product; your review must not contain offensive profanity, abusive language, or discriminatory references based on race, religion, gender, or disability; and you must not be affiliated with a competitor if posting a negative review.
  • Our Discretion: We reserve the right to accept, reject, or remove reviews in our sole discretion. We assume no liability for any review or for any claims or losses resulting from user-posted content.
  • Submissions: Any questions, comments, suggestions, ideas, or feedback regarding the Site ("Submissions") that you provide to us may be used by us for any lawful purpose. We are not obliged to keep such Submissions confidential, to pay compensation, or to respond to them.

Section 6 - Pricing, Payment & Security

  • VAT: All prices include UK VAT at the current rate (20%) where applicable.
  • Price Changes: Prices for all products are subject to change at any time. All payments shall be processed in British Pounds Sterling (GBP).
  • Pricing Errors: In the event of a standard or backend pricing error, we will contact you before processing your order. You will have the option to proceed at the correct price or cancel for a full refund. We retain the strict right to correct pricing errors even after payment has been received.
  • Security: Payments are processed through Shopify's secure payment portals. We do not have access to, nor do we store, your full card details.

Section 7 - Shipping, Delivery & Supplier Dependency

  • Transit Times: Standard delivery is typically 2–3 working days; express is 1–2 working days. These are structural estimates and not legal guarantees.
  • Direct Dispatch: To ensure optimal freshness and quality, some items (including livestock and specialist goods) are dispatched directly from our specialist third-party suppliers.
  • Supplier Dependency: Fulfilment of direct-dispatch orders is strictly subject to the operational constraints, stock levels, allocation policies, and regional capabilities of those third-party suppliers. If a supplier experiences a sudden crop failure, stock shortage, or discontinues an item, we reserve the right to cancel your affected order and issue a full refund within 14 calendar days, without further liability to you.
  • Address Accuracy: It is your responsibility to ensure your delivery address is complete and correct at checkout. We cannot accept liability for non-delivery or loss resulting from an incorrect address being provided.
  • Surcharges: Larger or heavier items (pallets/long lengths) to certain regions may incur additional delivery surcharges, calculated at checkout before payment.

Section 8 - Returns & Refunds Summary

Our full Refund & Return Policy is available on our dedicated store policy page. The primary legal terms are:

  • Cooling-Off Period: Under the Consumer Contracts Regulations 2013, you have the right to cancel non-perishable orders within 14 days of receipt without giving a reason.
  • Perishable Goods Exemption: Live material (seed potatoes, bulbs, tubers, plants) cannot be returned or cancelled once dispatched, in accordance with Regulation 28(1)(b) of the Consumer Contracts Regulations 2013.
  • Non-Perishable Goods: We offer an extended 30-day return window for unused, unopened hard goods (tools, décor, hardware) in original packaging.
  • Faulty or Damaged Items: Under the Consumer Rights Act 2015, you are entitled to a repair, replacement, or refund for faulty goods. You must notify us within 14 days of receipt with photographic evidence. We will cover return shipping costs for verified faulty items.

Section 9 - Third-Party Websites & External Content

  • The Site may contain links to other websites ("Third-Party Websites") as well as articles or graphics originating from third parties.
  • Such Third-Party Websites are not monitored or checked for accuracy or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site.
  • Inclusion of or linking to any Third-Party Website does not imply approval or endorsement thereof by us. If you decide to leave the Site and access third-party links, you do so entirely at your own risk.

Section 10 - Warranties & Care Exclusions

  • Third-Party Manufacturer Warranties: Most manufactured hardware items carry a third-party manufacturer warranty against defects. For these brands, the warranty agreement is directly between you and the respective manufacturer; Go To Garden does not provide independent warranties for external brands.
  • General Exclusions: Warranties do not cover normal wear and tear, product misuse, neglect, or damage caused by exposure to improper chemicals or corrosive fertilisers.
  • Timber Care Exclusions: For natural wood items and our bushelcrate range, warranties explicitly exclude natural cosmetic weathering, wood checking/splitting over time, colour fading, or natural rot caused by improper storage, lack of wood treatment, or prolonged exposure to severe outdoor moisture. All tools and wooden items should be cleaned after use and stored in a dry environment.

Section 11 - Disclaimers & Limitation of Liability

  • Disclaimer: This site is provided on an as-is and as-available basis. You agree that your use of the site and its services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the site and your use thereof.
  • Limitation of Liability: To the fullest extent permitted by law, Go To Garden, its directors, employees, or agents shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of our website or products.
  • Liability Cap: Our liability to you for any cause whatsoever will at all times be limited strictly to the amount paid, if any, by you to us for the affected goods. Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Section 12 - Indemnification

You agree to defend, indemnify, and hold Go To Garden harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable legal costs and expenses, made by any third party due to or arising out of: (1) your unauthorised commercial use of the Site; (2) a breach of these Terms of Service; (3) any breach of your representations and warranties set forth in these Terms of Service; or (4) your violation of the rights of a third party, including but not limited to intellectual property rights.

Section 13 - Electronic Communications

By using this Site, you consent to receiving communications from us electronically. We will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing, in accordance with the Electronic Communications Act 2000.

Section 14 - Governing Law & Jurisdiction

  • These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of England and Wales.
  • Any disputes or legal claims arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
